Privacy Shield Policy

General

At Precognitive, Inc. (“the company”, “Precognitive”, “we” or “us”), we are committed to protecting your privacy. This statement outlines our general policy and practices for implementing and complying with the Privacy Shield Program, including the types of personal data the company gathers, how we use it, and the choices affected individuals have regarding our use of, and their ability to correct, the personal data relating to them.

This policy applies to personal data we handle. For purposes of this statement, “personal data”, “personal information”, or “personally identifiable information” means information that:

  • Is transferred from the European Economic Area (EEA) and Switzerland to the United States in reliance on the Privacy Shield Framework;
  • Is about, or pertains to, a specific individual; and
  • Can be linked either directly or indirectly to that individual.

Personal Data from the EU

Precognitive complies with the EU-US and Swiss-US Privacy Shield Frameworks as set forth by the US Department of Commerce (the “Shield”) regarding the collection, use and retention of personally identifiable information from the EU and Switzerland.

Precognitive has certified to the Department of Commerce that it adheres to the Privacy Shield Principles in respect of all personally identifiable information received from the EEA and Switzerland in reliance on the Shield.

The Federal Trade Commission has jurisdiction over Precognitive’s compliance with the Privacy Shield. If there is any conflict between the terms in this policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Personally Identifiable Information Collection

Precognitive will only process and retain personally identifiable information in ways that are compatible with the purposes for which it was collected, or for purposes our customers or users later authorize. Before we use personally identifiable information for a materially different purpose, we will provide the individual or organization with the opportunity to opt-out.

Transfers to Third Parties

Precognitive may share personal information with third party vendors, consultants and other service providers who are working on our behalf and with whom the sharing of such information is necessary to undertake that work.

We may disclose personal information to a third party where we are legally required to do so in order to comply with any applicable law, regulation, legal process or government request.

We may disclose personal information if we believe it necessary to protect the vital interests or legal rights of Precognitive, our Customers or the rights or property of others.

We may provide personal information to our affiliates (meaning any subsidiary, parent company or company under common control with Precognitive). Our affiliates will use such information only as described in this Policy. Additionally, if Precognitive is involved in a merger, acquisition or sale of all or a portion of its assets, Personal information may be shared or transferred as part of that transaction, as permitted by law.

If we transfer any personally identifiable information to a third party acting as an agent, we will be responsible for any acts of those third party agents that are inconsistent with the Privacy Shield Principles, unless otherwise provided by law.

Disclosures for National Security or Law Enforcement

Please note that under certain circumstances, we may be required to disclose personally identifiable information in response to lawful requests by public authorities, including requests relating to national security or law enforcement requirements.

Access Rights

Individuals may have the right to access personally identifiable information that Precognitive holds about said individual and request that Precognitive corrects, amends, or deletes it if it is inaccurate or processed in violation of the Privacy Shield. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of a third party.

If you would like to request access to, correction, amendment, or deletion of your personally identifiable information, you can submit a written request to the contact information provided below. Precognitive may request specific information from you to confirm your identity.

Privacy Rights and Choice

If you are a resident of the EEA, you can object to processing of your personal information, ask us to restrict processing of your personal information or, if applicable, request the portability of your personal information. You can send an email to privacy@precognitive.com to exercise these rights.

If you are a resident in the EEA, you have the legal right to complain to a data protection authorities in the EEA about Precognitive’s collection and use of their personal information. Complaints & Resolution

In compliance with the Privacy Shield Principles, we commit to resolve complaints about our collection or use of your personal information. EEA and Swiss individuals with inquiries or complaints regarding our Privacy Shield practices should first contact us at privacy@precognitive.com or in writing to:

We will investigate and attempt to resolve any Shield-related complaints or disputes within forty-five (45) days of receipt.

If you have an unresolved Privacy Shield complaint that we have not addressed satisfactorily, please contact JAMS, our US-based third party dispute resolution provider free of charge.
